Contract for Wedding Photography Services

This constitutes an agreement for photographic services. It is also understood that any and all negatives and digital images remain the property of the photographer, Shannon M. Mackay, D.B.A. DDP and they may be used for advertising, display or any purpose thought proper by DDP.  The photographer for this event will be Shannon M. Mackay Studio/photographer/owner may substitute another photographer to take the photographs in the event of photographer’s verifiable illness or of emergency scheduling conflicts. In the event of such substitution, photographer warrants that the photographer taking the photographs shall be a competent professional and will be performed without additional charge.  DDP and its photographer(s) shall not be held accountable for any unforeseen delays in the order(s). Negatives, if any, are kept indefinitely It is the client’s responsibility to contact the photographer for their negatives. In the event of digital photography, where no negatives exist, there will be no delivery of negatives at any time unless agreed upon prior to the event date. Copies of digital images will be stored on hard drives or CD’s and can be made available one year after the event for a nominal fee. If no request has been made within 90 days of the one-year anniversary of the services provided, DDP reserves the right to dispose of any digital files as they see fit.  If the photographer cannot perform this Contract due to fire or other casualty, theft, strike, act of God, or other cause beyond the control of the parties, or due to photographer’s illness or emergency, then the photographer shall return the retainer to the Client but shall have no further liability with respect to the contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the photographer. Although all care will be taken with the negatives, digital media and photographs taken at the event, the client agrees that the photographer limits any liability for loss, damage, or failure to deliver pictures, for any reason, to no more than the return of all payments made. Photographer is the sole professional photographer allowed to photograph the event. Amateur photographers may take photos during the event if the do not interfere with the contracted photographer. If so the on-site event representative will be advised to handle the situation. Upon signature of contract or receipt of retainer either in person, by mail or electronic funds, the photographer reserves the time and date agreed upon, and will not make other reservations for that time and date. For this reason, all payments and retainer fees are nonrefundable, even if the date is changed or the event is canceled for any reason. All payments are due and payable in New Hanover, CO.

A non-refundable retainer is due at signing of this contract. The retainer will be equal to 50% of the current full cost of the service requested. At the photographer’s discretion, a partial retainer may be accepted to hold the date with the balance due no later than two weeks prior to the service date. No part of any order, including previews, if any, will be delivered until the balance is paid in full. Prices are subject to Wisconsin and Local Government sales tax. The studio is not bound until the nonrefundable retainer is paid and received and this agreement is signed. This Agreement may be executed in any number of counterparts confirmed by facsimile signatures transmitted by telephone, each of which shall be deemed a duplicate original.  Additional portrait reprints can be purchased from DDP at any time in the future.

Please note that any services performed in addition to the contracted services will be billed at the agreed upon prices stated below.  Also note that all deposit(s) paid are non-refundable, but may be applied toward other packages or services.

Additional Hour of Event Coverage $100.00 per Hour

Additional Assistants Hourly Fee $50.00 per Hour

Extensively Retouched Photos $100.00 per Hour (only at your request)

Mileage Travel Time Fee (if outside the Greater Cape Feararea) Within 30 miles, after that distance client will be billed at $1.00 per mile. Plus a per diem of $25.00 per meal and extra expenses if any will be charged at actual cost of expenses. Ex: Hotel rental for overnight stays, rental equipment, taxi fares, any expenses that are incurred during the event that were not discussed or arouse during the event.
